Methods To Know the Various Forms of Personal Injuries

By Douglas L. Taylor

If you're a victim of a bodily abuse that caused you physical injuries, emotional hurts, and/or mental anguish due to the carelessness of another person, business or institution, you could file a case of personal injury. If it costs you sleepless nights, your work or efficiency, you can file and claim for damages or injuries. There are various types or categories of personal injuries; it is vital to learn them especially the ones that cannot be neatly grouped. Consulting a legal professional is always the best option.

If you have been bodily injured or hurt - bodily, psychologically, emotionally - deliberately or due to carelessness of certain people, you can file a case and claim for loss. Contrary to what many people may think, a personal injury is more than a busted bone or perhaps a soft-tissue laceration; it may or may not involve bodily destruction.

Physical injury is a legal jargon which is typically heard in lawsuits as the plaintiff accuses a person of negligence. If the accusation is sufficiently substantiated in the court of law the plaintiff who has endured and incurred some costs can even claim compensatory damages for what was lost due to the injury.

There are several types or kinds of personal injury which can be a valid reason for a legal action. It can be generally categorized into four groups: physical, intentional, financial, and injury to reputation. Hence, a case of personal injury may involve these classes.

* The Injury which Involves Physical or Bodily Harm

This is the most connected form of injury to the term "personal injury" where there are bodily or physical damages or injuries sustained due to someone's carelessness. The most typical types are:

a. Car Accidents - These usually involve a motorist which due to careless disobedience of traffic laws or carelessness causes a car accident which causes harm to innocent people or bystanders.

b. Premises Liability - These cases occur in an area that is owned, maintained or monitored by an individual, agency or business that is held responsible for the safety of the location. Incidents that may happen such as dog bites, construction accidents, and commercial or work accidents are considered their responsibility.

c. Healthcare Related - These types of cases may cause fatality, loss of a working body part or leave the patient with a long-term health-related impairment. These could occur with medical negligence, misdiagnoses, delayed management of life-saving treatments, deaths due to a prescribed medicine, death because of malfunction of a healthcare device, failure to maintain the privacy of healthcare records and other forms of unprofessional conduct.

d. Exposure and Impact of Poisonous Substances - These are injuries which a society or group of people may experience because of the careless use and disposal of users of poisonous products. A few examples are asbestos, pollution elements, road paving components, industrial waste products and hospital wastes.

* Deliberate Injury

These are serious injuries that are usually premeditated and violent and sometime even bordering on heinous crimes. The outcomes are typically serious on the bodily, mental and emotional state of the victim. A few examples involve spousal mistreatment, kid abuse, bodily assault, rape, incest, law enforcement brutality, violence, hazing and corporal punishments.

* Economic or Fiscal Damage

It is inevitable that with physical harm comes cost. It can be in the form of seeking medical remedies, rehabilitation and surgeries. It could also be as the sufferer was not able to work and earn after the injury was inflicted or because the temporary or permanent impairment has already prevented the victim from doing similar work which he/she used to do. Should any of this occurs, the plaintiff can also file for a claim for injuries.

* Injury to Reputation

This is a crime which has something to do with the damaging of the identify or standing of the sufferer. This can cause an individual to lose sleep due to mental anguish or lose earnings for suffering from distress and emotional turmoil. The most common cases filed under this kind of category are slander as well as oral defamation.

There are also times when the offense managed by a personal injury attorney can't be so easily categorized because of the surrounding circumstances. Whatever the type or category of personal injury, you know when you have been injured and you must know your legal rights. It's always good to know what your legal options are. Seeking assistance from an attorney always serves well.
